SPONSOR: Lenovo (United States) Inc. (” Sponsor” or “Lenovo”)
1. ELIGIBILITY: The Lenovo Laptop Contest (“Contest”) is open to all high school and college students who are legal residents of the fifty (50) United States and the District of Columbia, who are seventeen (17) years of age or older at the time of entry and who are currently enrolled (or planning to enroll no later than the Fall 2022) in an accredited post-secondary institution of higher learning (college, university or trade school). Current employees, officers, directors and agents of Sponsor and its related companies and members of their immediate families (defined as spouse, parents, siblings and children) and persons residing at the same address are not eligible to win. Void where prohibited.
2. ENTRY PERIOD: You may enter the Contest beginning at 8:00 AM ET on June 15, 2020 and ending at 11:59 PM ET on July 15, 2020 (“Entry Period”).
3. HOW TO ENTER: To enter, each eligible applicant (“Applicant”) should submit a complete entry online at the following Website (https://www.myscholarship.app/lenovolaptopcontest) during the Entry Period (each, an “Eligible Entry”). Eligible Entries must be submitted no later than July 15, 2020 at 11:59 pm Eastern Time. Limit one (1) Eligible Entry per person. Eligible Entries must include name and contact information, background details, academic details, and a short original, previously unpublished written response to the topic, “Tell us how a Lenovo computer would help your educational goals.” Your written response must be in English, with correct spelling and grammar, and it must not exceed five hundred (500) words. No substitutions of new drafts or corrected pages will be accepted once you have submitted your original Eligible Entry. Eligible Entries may not include any content that (a) is libelous or defamatory; (b) is profane, obscene, pornographic, or sexually explicit; (c) violates a person’s right to privacy or rights of publicity; (d) degrades others on the basis of gender, race, class, ethnicity, national origin, religion, sexual preference, disability, or other classification; (e) is discriminatory, derogatory, predatory, hateful, or intended to intimidate or harass; (f) contains or advocates illegal, unlawful or violent acts; (g) infringes upon or violates any third party copyrights, trademarks or other intellectual property rights; or (h) otherwise violates any local, state, or national law, rule or regulation. Entries that contain such content or are otherwise objectionable will be disqualified at Sponsor’s sole discretion. All Eligible Entries become the property of the Sponsor and will not be returned. Sponsor assumes no responsibility for lost, late, misdirected, or unintelligible entries. By submitting an Eligible Entry, you fully and unconditionally accept and agree to these Official Rules and the decisions of the Sponsor, which are final and binding.
4. SELECTION OF POTENTIAL WINNERS: Sponsor is looking for eligible Applicants who follow directions to submit essays that are well-written and clearly and creatively address the topic described above. On or about July 31, 2020, a qualified panel of judges will select five (5) potential winners based on the criteria of writing ability (25%), creativity (25%), originality (25%), and overall excellence (25%). Sponsor will notify the five (5) selected Eligible Entries as the potential Prize Winning entries by email. In the event of a tie, the potential winner of such tie will be the Applicant with the higher score for overall excellence. Once the potential winners are notified by e-mail, he/she will each be required to sign further documentation as explained below. In the event that any potential winner does not respond to such notification within 48 hours, declines a Prize for any reason, or does not meet the eligibility requirements set forth in these Official Rules, as determined by the Sponsor, the potential winner will be disqualified and an alternate potential winner may be selected from among the remaining Eligible Entries. Sponsor shall have no liability for any potential winner notification that is lost, intercepted or not received by the potential winner for any reason. Sponsor reserves the right to choose no Prize recipient if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries. Portions of the Prize Winning entries may be posted on the Sponsor’s Website, Social Media, or used in other marketing materials, without further compensation or notice to the winner.
5. PRIZES: Five (5) winners will each receive one (1) Lenovo ThinkPad X1 Carbon Gen 7 (“Prize”). Retail value of the computer is $2,179. Upon confirming verification, Prizes will be shipped directly from Lenovo to the physical address provided by the winners. Lenovo is unable to ship to PO Boxes. Upon delivery to the winner’s address, Sponsor will be deemed to have awarded the Prize to the winner with winner assuming full responsibility for the Prize. Sponsor shall not be held responsible for any delays in awarding the Prize for any reason. Each Prize will only be awarded to a verified winner. The Prize value in these Official Rules is approximate only. You will not be compensated if actual Prize value is lower than the value quoted in these Official Rules. Only the Prizes specified in the numbers indicated above will be awarded. Sponsor reserves the right to substitute a prize or prize component of equal or greater value should a Prize or any component of a Prize become unavailable. Prizes may not be resold, and will not be replaced if lost, destroyed, or stolen. Except as specifically provided herein, Prize packages do not include insurance, personal expenses, incidental charges, gratuities, or any other items not specifically described in these Official Rules. Standard product warranties apply.
Prize recipients must submit proof of enrollment in a post-secondary educational institution on or before 9/30/2022, and/or other proof of identity or eligibility as required by Sponsor. Failure to provide any such proof upon request may result in disqualification. Prize may not be assigned, transferred, or changed, except at the sole discretion of Sponsor. No cash equivalent prize will be awarded. The awarding of any Prize is contingent upon full compliance with these Official Rules and subject to Sponsor’s verification of Applicant and Applicant’s submission. Applicants agree to be bound by Official Rules and agree that if any Prize recipient fails to provide proof of identity, refuses to provide required affidavit, refuses to complete and provide any requested tax forms (including IRS W-9 form), declines to accept the Prize, does not comply with Sponsor’s instructions, is found to have violated the Official Rules or otherwise does not meet eligibility criteria, or if the Prize is returned as undeliverable, Prize will be forfeited and the Applicant who submitted the Eligible Entry with the next highest score will become an alternate potential Prize recipient. Applicants understand that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this Contest or acceptance, possession and use of Prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the Prize. Taxes and usage charges on Prizes are sole responsibility of Prize recipients. Prize recipients will be issued 1099 tax forms.

7. PUBLICITY: Except where prohibited, by accepting a Prize, the Prize recipients agree that Sponsor may, without any limitation or further compensation or notice, use his or her name, photograph, voice and/or likeness, and any statements made by such Prize recipients, worldwide in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and/or internet), for all legitimate business purposes, including for the purpose of advertising and promoting the Website, the Sponsor or its products and services, the Contest, or any other promotion, contest or sweepstakes sponsored by Lenovo.
8. OWNERSHIP: By submitting an Eligible Entry, you acknowledge and agree that: (a) Sponsor will own such Eligible Entry, including any material submitted with your entry (e.g. photograph, video, written submission, or other form of submission, as applicable) (all such material, collectively, the “Entry Material”), and (b) as between you and Sponsor, Sponsor will own all publishing rights in and to the Entry Material. Each Applicant hereby irrevocably grants, transfers, sells, assigns and conveys to the Sponsor, its successors and assigns, all present and future right, title and interest of every kind and nature whatsoever, including, without limitation, all copyrights, and all rights incidental, subsidiary, ancillary or allied thereto (including, without limitation, all derivative rights) in and to the Entry Material for exploitation throughout the universe, in perpetuity, by means of any and all media and devices whether now known or hereafter devised (the “Rights”). Sponsor shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter, the Entry Material for any purpose which Sponsor deems necessary or desirable, and each Applicant irrevocably waives any and all so-called moral rights they may have in the Entry Material submitted by him or her. Each Applicant hereby acknowledges that such Applicant does not reserve any rights in and to the Entry Material.
9. DISPUTE RESOLUTION: Except where prohibited, by participating, Applicant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor and their agents shall be governed by and construed exclusively in accordance with the laws of the state of North Carolina without giving effect to any principles of conflicts of law of any jurisdiction. Applicant agrees that any action at law or in equity arising out of or relating to this Contest, or awarding of the Prizes, shall be filed only in the state or federal courts located in the state of North Carolina and Applicant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Contest, Applicant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or awarding of the Prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
10. REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION. Each person who enters this Contest represents and warrants to Sponsor as follows: (i) the Entry Material is the Applicant’s own original, previously unpublished, and previously unproduced work; (ii) the Entry Material is wholly original to Applicant and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (iii) Applicant has all rights necessary to submit the Entry Material in the Contest and to grant the rights granted to Sponsor herein; (iv) the Entry Material neither infringes upon nor otherwise violates the intellectual property rights or other rights of any other person or entity; and (v) the Entry Material does not and will not violate any applicable laws, and meets the Submission Requirements set forth above. Each Applicant hereby agrees to indemnify and hold the Sponsor harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of Applicant hereunder.
11. FURTHER DOCUMENTATION: Except where prohibited, potential Prize recipients (or their parents or legal guardians if they are minors at the time of entry) will be required to complete and return an Affidavit of Eligibility, Publicity/Liability Release, and Copyright Assignment within ten (10) days of notification or the Applicant with the Eligible Entry with the next highest score will become an alternate potential Prize recipient. If notification to a potential Prize recipient is returned as undeliverable, the Applicant with the Eligible Entry with the next highest score may become an alternate potential Prize recipient. Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to Sponsor his/her Prize.
12. NO OBLIGATION TO USE. Sponsor shall have no obligation (express or implied) to use any winning Entry Material, or to otherwise exploit any winning Entry Material or continue the development, production, distribution or exploitation thereof, and Sponsor may at any time abandon the use of the winning Entry Material for any reason, with or without legal justification or excuse, and the Prize recipients shall not be entitled to any damages or other relief by reason thereof.
13. IMPORTANT. PLEASE READ – GENERAL RELEASE AND LIMITATIONS ON LIABILITY. By entering the Contest, each Applicant acknowledges and agrees that the Sponsor, its related companies, affiliates, and each such company’s respective employees, officers, directors and agents (collectively, the Releasees”) are not responsible for, and Applicant hereby agrees to indemnify and hold harmless each of the Releasees for, any claims, demands, causes of action, costs, injuries, losses, liabilities or damages of any kind arising from or in connection with: (i) incomplete, lost, late, misdirected or illegible entries or for failure to receive entries due to any cause, including without limitation human, transmission, or technical problems, failures, or malfunctions of any kind, whether originating with sender, or otherwise, that may limit an Applicant’s ability to participate in the Contest; (ii) the awarding, receipt, possession, use or misuse of any Prize, in whole or in part; (iii) any breach of these Official Rules; or (v) any injury or damage resulting, directly or indirectly, in whole or in part, from participation in the Contest and/or the use of any Prize, including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the Applicant’s rights of publicity or privacy, or the Applicant’s claim that he or she has somehow been defamed or portrayed in a false light. Sponsor further assumes no responsibility for any damage to an Applicant’s computer system which is occasioned by accessing the Website or participating in the Contest, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature, or for the incorrect or inaccurate capture of information, or the failure to capture any information. This Contest is subject to all U. S. federal, state and local laws and regulations. Void where prohibited.
14. SPONSOR’S RIGHT TO MODIFY, SUSPEND OR TERMINATE. In the event Sponsor is prevented from continuing with the Contest as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond its reasonable control, then Sponsor shall have the right in its sole discretion to modify, suspend, or terminate the Contest, or select winners from among all Eligible Entries received prior to such cancellation.
15. GENERAL PROVISIONS. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the Website, to be acting in violation of these Official Rules, to be submitting responses dishonestly or inaccurately, or to be acting in an unsportsmanlike or disruptive manner. In the event of a dispute as to the identity of any entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. If an Eligible Entry is confirmed by Sponsor to have been erroneously deleted, lost or destroyed, the entrant’s sole remedy shall be another Eligible Entry, if time permits. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or of any other provision.
16. LIST OF PRIZE RECIPIENTS: The names of the Prize recipients of this Contest may be posted to Lenovo’s website, social media or other marketing materials after the winner has been notified. To obtain an official list of the name of the winner, send a self-addressed stamped envelope to: Lenovo, Attn: Jessica Tomlinson, 8001 Development Drive, Morrisville NC 27560. Requests must be received by August 30, 2020.
